This page tells you the terms and conditions on which we agree to supply any of the products or services listed on this website www.blackmountainfabric.co.uk. By placing an order for any of our products or services, you agree to be bound by these terms and conditions. These terms and conditions apply to your use of this website, www.blackmountainfabric.co.uk and to any order of a product or service that you may make while doing so.
Your use of Black Mountain Fabric and any purchase made by will be governed by Law and will be deemed to have occurred in the United Kingdom. Any dispute arising from our dealings must be heard by the courts in England or Wales.
By placing an order with us, you warrant that you are legally capable of entering into a binding contract, and you agree that these terms and conditions should form the contract between us.
The terms ‘Black Mountain Fabric’, ‘BMF’, ’BMFabric’, ‘us’ or ‘we’ refer to the owner of this website and supplier of the products and services (workshops) outlined in these terms.
The term ‘you’ refers to the viewer or user of this page.
The term ‘workshop(s)’ refers to the provision and services of a workshop provider coordinated and facilitated by Black Mountain Fabric.
The term ‘facilitator’ refers to any person who officially represents our company for the purpose of providing our workshops.
The term ‘customer’ or ‘organisation’ refers to any person or organisation who places an order of one of our products or services with us.
The term ‘order’ refers to an agreement through email, phone call, verbally or in print to enter a contract to purchase products or services from us.
The term ‘booking’ refers to an agreement through email, phone call, verbally or in print to enter into a contract to reserve and engage in our services in advance.
The term ‘Intellectual Property Rights’ or ‘IP’ refers to all copyright and other intellectual property rights, howsoever arising and in whatever media, whether or not registered, including (without limitation) patents, trademarks, rights in any format or presentation (including its look, feel, visual or other non-literal elements) and any applications for the protection or registration of these rights and all renewals and extensions thereof throughout the world.
The term ‘feedback form’ refers to any form or review link that we may send to a customer on completion of their ordered workshop.
Refunds and returns
We’re confident you’ll be happy with the quality of your purchase at Black Mountain Fabric. But in the event that this is not the case, we’ll always work hard to resolve any problems.
Once fabric is cut to your requirements, unless it is faulty or flawed we cannot accept returns. We advise customers who purchase from us to always check the fabric prior to cutting, as once the fabric is cut; it is deemed non-refundable/non-returnable.
All other items are also non-refundable unless faulty or flawed.
We will require a receipt to confirm the purchase and refunds can be given no longer than 14 consecutive days from the date of purchase.
We do not disclose customer information to any third party companies. Data collected in store is securely saved in accordance to The Date Protection Act. Our mailing list for customers who wish to be sent relevant information is provided by MailChimp or WordPress, and is stored in accordance to their terms and conditions. For card payment purposes, (when your request an e-mail receipt) the details are sent to Paypal or Mypay and are stored in accordance to their terms and conditions.
Black Mountain Fabric Workshops
The workshops designed and advertised have been planned to cater for learners of all abilities. Any given selection can be shown at any time and we may update our topic offerings as we see fit. The workshop that you book will be the workshop that you receive, unless notified of any unforeseen or unavoidable change.
While we do not expect this to happen often, we reserve the right to alter, vary, omit or substitute any part or parts of any workshop provided by us described in any promotional or other materials published by us or on our behalf.
In the event of any change in any content as described above, we will have no liability to refund any part of any fee or deposit paid.
We will provide relevant information about our team members on our website and provide you with contact details for your specific facilitator once your booking has been confirmed.
You are free to reach out to one of our facilitators to make enquiries or arrange a chat, however all booking and payment related processes will be handled by our central system and by our team based at Black Mountain Fabric in Wales.
Our workshop facilitators will all be required to complete health and safety assessments and in undertaking workshops in representation of Black Mountain Fabric, will be covered by our company’s public liability policy. Our facilitators are not employees of Black Mountain Fabric, rather they are independent freelance agents who are responsible for their own tax and national insurance arrangements with HMRC.
Facilitators working with children and young people may not be CRB checked, and therefore cannot provide services to anyone under 18 unless they are accompanied by a supervising adult. While our facilitators will have the capacity to assist with this, it is the parent/guardians responsibility to manage the behaviour of the child whilst the facilitator is undertaking a workshop. If the child is aged 16-18, we can provide a disclaimer for the parent/guardian to sign, to give permission for the child to attend as an adult.
We appreciate that class sizes often vary. With that said, we do cap class size numbers at a number that is reasonable for both pupils and our facilitators. This is to ensure that everyone can get the most out of their day. We try to limit numbers to a maximum of 10 students, or a maximum of 8 on a beginner’s class. This may vary, dependant on the particular class.
Workshops can be run over consecutive days or as a one-off, single class; please check if your class is a daytime, evening or a course (multiple days).
We work out of several venues; the main one being our workshop ‘The Gallery’ located in Hatherleigh Place. Our secondary venue is the Black Mountain shop on Cross Street in Abergavenny. Workshops may take place at any of the locations mentioned above, and can also be changed to one of these venues until 1pm on the day before the class. The learner is responsible for ensuring they have the most up to date information, including the venue location – we advise that you contact us the day before the class to ensure this. Due to time constraints, we are unable to chase up customers and will leave one voicemail or e-mail with all details using the contact details provided.
Customers are asked to arrive slightly early to each class. This will ensure the correct start and finish times for all learners. If a customer is not present 20 minutes after the start time, the space will be marked as a no-show, and no refunds will be given. We will endeavour to contact any learner who is a no-show, but this is only available if the tutor has sufficient time.
All venues are within easy reach of Abergavenny. If a change of venue occurs and you are unable to travel to the venue, please contact us ASAP as in rare cases, we may be able to offer transport.
Black Mountain Fabric and our facilitators accept no responsibility for any accidents or damages that occur during a workshop at the fault of the furnishings, materials or any other items belonging to or on loan from the venue. Each venue has been safety assessed and you will be made aware of any issues once the class begins.
Tea and coffee will be provided at most venues, and full day classes will have a mid-way, lunch break. Most of our venues have kitchen facilities which you are able to use. Please contact us for more information on your specific venue.
Black Mountain Fabric will provide materials to you if stated in the workshop description. This is to ensure that all learners will be dealing with the same fabric and accessories, as well as choosing the most suitable fabric for that particular class. Some workshops will not include all materials; it is the learner’s responsibility to provide this equipment at the class as we will not be able to provide spares.
Any electrical devices that are used by learners are done so at their own risk. Any damages or accidents that occur during a workshop that are the fault of any of the equipment or materials provided by the learner are the responsibility and liability of the learner. All electrical equipment should be serviced and safety tested before use.
Orders and Booking
Orders for our workshops or other products that we may sell can be made on our website, over the phone, in store or via Facebook. All bookings will be handled centrally through our online system. The person making the booking must have the authority to do this and is responsible for ensuring the learner complies with the terms and conditions.
A payment is required to confirm the booking of a workshop. This is usually 100% of the course value, unless the class fee is over £100. If the class is over £100, a deposit of 50% is required, and we will advise when the remaining amount is due. No places will be reserved until a payment is received. We will endeavour to contact you, but it is your responsibility to ensure full payment on or before this date. If we have not received full payment 3 weeks prior to the class, we reserve the right to collect your deposit as an administration fee, and re-sell your place as we usually have long waiting lists.
Prices are as quoted in correspondence or as advertised on the website but may be subject to change without prior notice. Payment can be made in cash in store, using our card payment system ‘Mypay’ (in store or over the phone) or via a Paypal link. Details will be sent for Paypal and transfers as soon as the customer requests to book a space, however the space will not be guaranteed until payment has cleared.
Bookings for Black Mountain Fabric workshops are only valid upon condition of the following:
– Acceptance of these Terms and Conditions and Cancellation Terms
– The fee has been paid
– The customer has understood what will be expected of them at the class
Upon meeting all of the above requirements you will then receive a confirmation email or a receipt of payment of deposit and detailing the workshop booking. Workshop bookings are an agreement to use services facilitated by Black Mountain Fabric. This agreement is made between the customer and us. It is non-transferable.
If you give more than 14 days notice to cancel a place on a workshop your options are as follows:
* We will be happy to transfer you to another workshop, space permitting.
* If there are no suitable future dates for you to transfer to we can provide a voucher to be used for a future workshop booking.
* You can of course send someone in your place at any time, but please note that this is your responsibility to find a replacement person and you must let us know in advance who will be attending.
If you give less than 14 days notice to cancel a place on a workshop then your options are as follows:
* If you would like to transfer, we can only transfer you to a future workshop if your place is re-sold.
* If you would like to transfer and the place is not re-sold, we can add you to a last minute availability waiting list for future dates of the workshop. If there are still unsold places on the workshop with 24-48 hours until the workshop is due to take place, we will offer you a place. Please note this option is not a guarantee of a space.
We will do our best to fill the place within this time. Please be aware that in our experience it can be difficult to fill places on workshops at short notice.
Multiple class sessions
Some of our workshop classes take place over several sessions. If you miss a session unfortunately we can not offer a make up session. If you require further tuition to complete your project you may be able to book 1:1 lessons depending on the project and tuition required.
Workshop cancellations by us
In the unlikely event that we have to cancel a workshop you will be given at least 24 hours notice and offered a transfer to another date, voucher to be used at another time or a full refund. We will not be held liable for any other costs or expenses that you may incur in the event of cancellation by us.
Copyright and Intellectual Property
Copyright and all other intellectual property rights in the products and services we provide shall remain at all times the property of Black Mountain Fabric. Customers shall acquire no rights in the content or materials except as expressly provided for in these Terms and Conditions. You may not reproduce, copy, duplicate, transmit, publish, display, distribute or sell any products or services from Black Mountain Fabric for external parties.
Customers or website users may not use Black Mountain Fabrics online/offline materials, products and/or services for any commercial purpose, including the collection and use of any listings, descriptions or process. You may not make any derivative or commercially exploitative use of our website, its contents, or our products and services, download or copy account information or use any data mining, robots or similar data gathering and extraction tool without the explicit written consent of Black Mountain Fabric.
Any unauthorised use of our website, products and/or services will terminate our relationship and may give rise to a claim for damages and/or be a criminal offence.
At no time shall you display, upload or input any of our materials to websites or online platforms (their own, public or commercial) without prior authorisation by Black Mountain Fabric.
All images on our website are for the express purpose of editorial purposes and must not be shared or transferred resold or redistributed. Uploading any image to a website or network at a resolution that exceeds the display resolution of the intended viewing device will be deemed to be an attempt to redistribute the image.
Our website may, from time to time, provide links to other websites or resources. Black Mountain Fabric has no control over such websites and resources.
Images & Film
Black Mountain Fabric Limited reserves the right to use images and film made during the workshops for marketing and promotion. Images or film containing persons participating in a workshop will not be distributed unless consent has been obtained by the participant or by guardians of the participants. We will provide a ‘Photography Consent Form’ at any class we may be collecting images from.
If there are any problems in regard to the recording of images or film, please let us know in advance of your workshop taking place.
We aim to operate nationally, and are building a network of talented facilitators across Wales and the rest of the UK. Some of these facilitators will be listed on our main site and you are free to get in touch them as your direct point of contact. Booking, payment and other initial enquiries will be made with Black Mountain Fabric directly. Once the deposit is paid and terms and conditions agreed to, then the details can be exchanged so they are able to communicate directly. Communication differs between facilitators, and some tutors may only give details to be contacted by customers in an emergency. If this is the case, all questions and queries should be directed to Black Mountain Fabric where we will liaise with the tutor privately.
We strive to provide the best possible service and the feedback of our customers is crucial to this. As such, we may send a feedback form to you upon completion of your workshop. Your feedback will be passed on to the facilitator so they are able to reflect on their successes and better, where possible, the workshops and services they provide. Complaints regarding any of our facilitators or services will be handled through Black Mountain Fabric. Please contact us directly should you have a complaint to make about any of our facilitators or services. All complaints are taken seriously and will have a course of action set out by the team here to meet the complaint adequately. Black Mountain Fabric reserve the right to use any feedback given in their marketing, promotions and documentation materials.
The above Terms and Conditions as well as any other written agreements between Black Mountain Fabric and the customer shall form the basis of the contract between the two. Black Mountain Fabric reserves the right to change and amend the Terms and Conditions as it deems necessary from time to time and it is the responsibility of the customer to review these terms as such.
